1. Area of application
2. Selection of products and purchase of vouchers and aqua courses
(1) The customer has the possibility to select and order products on the above mentioned website. (2) The customer can click on the desired products on the website. These are collected in a virtual shopping trolley and at the end of their purchase, the customer receives a summary of the products and the total final price (including VAT). The list prices at the time of the order apply, as shown on the website. (3) You can have the vouchers and aqua courses sent to you or a third party by email.
3. Conclusion of the contract
The contract comes into effect when the booking dialogue is completed on
https://shop.freizeitbad-stegermatt.de. After placing your order, you will receive a confirmation email with your order details.
4. Dispatch
Online vouchers and aqua courses for self-printing are sent by email as a PDF attachment to the email address specified in the order.
5. Redeeming vouchers
The voucher data is encrypted in a barcode. When the voucher is redeemed at the Freizeitbad Stegermatt Offenburg cash desk, the barcode is scanned into the cash register system. The barcode is decrypted and the voucher data is displayed. A voucher can also be redeemed in partial amounts over multiple visits or by several people visiting at the same time. In the event of misuse, we reserve the right to impose a ban and report the misuse.
6. Right of revocation
(As of August 2011) Consumers are entitled to a right of revocation according to the following stipulations, whereby a consumer is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their self-employed professional activity:
(1.) Right of revocation
You can revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter, fax, email) or - if you received the item before expiry of the period - by returning the item. The period commences upon receipt of these instructions in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and not before we have fulfilled our obligations to inform according to Article 246 § 2 in conjunction with § 1 subsections 1 and 2 of the EGBGB (Introductory Act to the German Civil Code) as well as our obligations according to § 312g subsection 1 clause 1 of the BGB (German Civil Code) in conjunction with Article 246 § 3 of the EGBGB. The timely dispatch of the revocation or the item is sufficient to safeguard the period of revocation. The revocation must be sent to: Offenburger Badbetriebs GmbH Stegermattstr. 11-15 77652 Offenburg, Germany Authorised Managing Director: Tim-Niklas Hockenjos Email:
info@freizeitbad-stegermatt.de
(2.) Consequences of revocation
In the event of a valid revocation, services received by both parties and any derived benefits (e.g. interest) must be returned. If you cannot return or hand over the received service and benefits (e.g. benefits of use) in their entirety or only in a deteriorated condition, you must compensate us for the value in this respect. You only have to pay compensation for the deterioration of the item and for any derived benefits insofar as the utilisation or deterioration can be attributed to the handling of the item, which go beyond the scope of testing the features and functionality. "Testing the features and functionality" is understood to mean testing and trying out the respective goods as is possible and customary in a retail shop. Items which can be sent by parcel are to be returned at our risk. You are responsible for bearing the regular return costs if the delivered goods correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the item, you have not yet paid the consideration or the contractually agreed partial payment at the time of the revocation. Otherwise, the return is free of charge for you. Items that cannot be sent by parcel will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. For you, the period begins with the dispatch of your declaration of revocation or the item, and for us, upon its receipt.
(3.) Right of revocation- exceptions
The right of revocation does not apply to purchased course tickets or other admission tickets which bear a fixed date, according to § 312b subsection 3 no. 6 of the BGB. End of the revocation instructions
