Liability is also excluded for claims resulting from the breach of a material contractual obligation. Material contractual obligations are those which arise due to the nature of the contract and whose non-compliance would endanger the purpose of the contract. In these cases, any liability for damages is limited to the foreseeable typically occurring damage. The operator is neither liable for force majeure or happenstance, nor for defects that may occur even upon exercising due diligence or which have not been identified.
  2. In the event of misuse or damage to the facilities, the guest shall be liable for damages as per legislation.
  3. A special cleaning fee of €50 will apply in the event of intentional soiling of the premises.
  4. The operator shall only be liable in the event of wilful intent or gross negligence for the loss of valuables, cash or clothing. This also applies to damage to items by third parties.

    1. Guests must safely store their ticket receipt and the following items provided by the pool facility:
      a) Wrist transponder
      b) Key for coin-operated locker
to prevent loss of such items. These must be worn on the guest, e.g. wristband worn, and not left unsupervised. Proof of compliance with these regulations must be provided by the guest in the event of a dispute.
    2. For culpable loss of items provided by the facility, the following flat rates shall apply:
      a) Wristband transponder with receipt €6,50
      b) If a wristband is lost and no receipt can be presented, a charge of €21.50 will apply (€6.50 for the lost wristband plus €15.00 for the average amount normally credited to the wristband transponder).

      d) Lost key for coin-operated locker = €65
      e) Towel €30
      f) Bathrobe €30
The user is expressly permitted to provide evidence that damage has not occurred or that it is significantly less than the flat rate fee.
